Ducks On The Ohio 2012

 

1.     A maximum of 50,000 ducks will be entered in the race.

 

2.     Ducks will be launched into the Ohio River at Dress Plaza at approximately 2:02 p.m. on Saturday, August 4, 2012.  The course will be established by the presenter.

 

3.     All ducks entered will be provided by the Presenter and shall remain the property of the Presenter.

 

4.     Once the ducks are launched, they are on their own.  No attempt to free or interfere with any duck is permitted, unless deemed necessary by the Race Committee.  The race course will close 30 minutes after the first duck has crossed the finish line.  Any duck finishing after that time will not be eligible for prizes.

 

5.     A number will be attached to each duck which corresponds to the number on its adoption paper.  Multiple duck entries from one adoption paper will be assigned additional duck numbers for identification.  The entrant names on the adoption papers corresponding to the first ducks, in order of finish, will be awarded the designated prizes, subject to the applicable rules described under rule 7 (“Million Dollar Duck”).  A list of prizes can be obtained from the Presenter by sending a written request and self-addressed stamped envelope to:  Ducks On The Ohio, 500 S. 6.     Presenter reserves the right, at its option, to substitute prizes of comparable value.

 

7.     Prior to the 18th Annual Ducks On The Ohio, one (1) "Million Dollar Duck Number" will be preselected at random for each group of 3,333 ducks adopted for the 2012 race.  If the number on the bottom of the winning duck (the duck finishing first) matches one of the preselected Million Dollar Duck Numbers, the "adoptive parent" will win the $1,000,000 (One Million Dollar) prize in addition to the First Prize.  In the event the number on the bottom of the winning duck does not match one of the preselected numbers, the $1,000,000 prize will not be awarded; however, the "adoptive parent" of the winning duck will win the First Prize as described in the 18th Annual Ducks On The Ohio "Adoption Papers."  The $1,000,000 prize will not be awarded if excess ducks (those not adopted) are launched in the race and one of the excess ducks is the winning duck.

            The $1,000,000 prize, if awarded, will be payable in forty (40) equal annual installments of $25,000 (Twenty-Five Thousand Dollars) each, without interest.  Contest rules concerning the awarding of the $1,000,000 prize are available from Ducks On The Ohio and from SCA Promotions, Inc. Ducks On The Ohio and Evansville Goodwill Industries, Inc. reserve the right to refuse to make the award due to any irregularity in the application of the contest rules.  A schedule of payments will be announced within ten (10) days after certification of the winning "adoptive parent," if any.

            Ducks On The Ohio and Evansville Goodwill Industries, Inc. shall have no liability or obligation with respect to any "Million Dollar Duck Number" winner in the event of a legitimate claim if SCA Promotions, Inc. and the insurer fail to discharge their payment obligations to any such winner.  Upon declaration of winning by Ducks On The Ohio and Evansville Goodwill Industries, Inc. in conjunction with SCA Promotions, Inc., the Million Dollar Duck Number Winner expressly releases Ducks On The Ohio and Evansville Goodwill Industries, Inc. from any and all liability from any non-payment by SCA Promotions, Inc. and such winner agrees to look solely to SCA Promotions, Inc. for such payment.

            Principals and Directors of Evansville Goodwill Industries, Inc. shall be ineligible to participate in the Million Dollar Duck Promotion and shall not be eligible for any prize covered herein.  The parties hereto acknowledge that SCA is not liable for any prize obligations to Promotion participants who are in violation of this provision.

 

8.     The combined suggested retail value of all prizes (not including the $1,000,000 prize) as established by the donor will be at least $10,000.

 

9.     The entry portion of each race ticket must be completely filled out and delivered to Presenter or an authorized representative of Presenter or mailed to Presenter at the address set forth in paragraph five (5) above and actually received by Presenter by 1:00 p.m. Saturday, August 4, 2012 to be eligible to win any prize.  No other tickets are eligible to win any prize.  Entrants assume the risk of nondelivery of any entries to Presenter or an authorized representative of Presenter.

 

10.   No purchase is necessary to enter or win.  Presenter does request, however, a donation of $5.00 per entry to benefit the Goodwill Family Center.

 

11.   Free entry tickets defeat the charitable fund raising purpose of the event and are not encouraged.  However, one free entry ticket per person can be obtained by presenting a handwritten request in person between the hours of 10:00 a.m. and Noon, Monday through Friday (except holidays) from the office of the Community Relations Director at Evansville Goodwill Industries, Inc., 500 S. Green River Rd., Evansville, IN  47715-7392.  Requests made for free entry tickets made after Noon on July 14, 2012 or after 15,000 ducks have been adopted will not be honored.  Entry tickets in exchange for a $5.00 donation each can be obtained from any representative of Presenter, from any point of purchase display and from other sources authorized by Presenter.

 

12.   Winners will be announced at the Duck Race awards ceremony located on the riverfront on Saturday, August 4, 2012 within approximately 60 minutes following the conclusion of the race.  Entrants will, where necessary, also be notified by United States Mail or by telephone. Race winners need not be present to win.  A list of race winners may be obtained from the Presenter by sending a written request and a self-addressed, stamped return envelope to Presenter at the address listed in paragraph five (5) of these rules and regulations.  If any race winner does not claim his or her prize within 30 days after August 4, 2012, Presenter will select a substitute winner through a random drawing of entry tickets.  All prizes will be awarded.

 

13.   All winners must prove eligibility.  All persons must be at least 18 years of age to enter.  Official operators and workers on the day of the Duck Race are not eligible to win.

 

14.   No cash equivalent prizes will be provided in lieu of the designated prizes.  Any and all taxes and similar fees, including but not limited to, applicable license and registration fees on any vehicles, are the sole responsibility of the winners.

 

15.   By entering, entrants release Presenter and its members, agents, employees and other related entities from any and all liability with respect to prizes.

 

16.   By entering, winners consent to the promotional use of their names and likenesses without additional compensation.

 

17.   Chances of winning depend on the total number of qualified entries.

 

18.   This event is subject to all federal, state and local laws and regulations and is void where prohibited by law.

 

19.   The conduct of the race, the determination of race winners, and the random drawing for unclaimed prizes will be audited and verified by a representative or representatives of an independent accounting firm.  All decisions and interpretations of rules and regulations will be made by Presenter, and its judgement is final.

 

20.   A copy of these rules and regulations is available from the Presenter at the address listed in paragraph five (5) of these rules and regulations.

 

21.  In the case of inclement weather, a random drawing will be held to determine the winning ducks.

 

22.  The Derby Duck Race/Turbo Turtle Trek is a licensed fundraising event of GAME - Great American Merchandise and Events.  The logo and name Derby Duck race/Turbo Turtle Trek are registered trademarks of GAME and cannot be used or copied without its written consent. 23.  Prizes will not be awarded if adoptions were issued in exchange for a check issued for "insufficient funds" or a debit card deemed "declined", "invalid" or "stolen."
